TikTok Creator Settles Lawsuit Over Apple Dance with Roblox

TikTok influencer Kelley Heyer, known for creating the viral ‘Apple dance’ inspired by Charli XCX’s song, has settled her lawsuit against Roblox. Heyer accused the gaming platform of using her choreography without permission, claiming it profited $123,000 (£93,000) from selling the dance as an emote in a popular game. The lawsuit was resolved after both parties agreed to dismiss the case, with a joint statement expressing mutual success in their creative endeavors. The ‘Apple dance’ became a viral sensation on TikTok and was later featured in Charli XCX’s live performances. Despite initially being excited to see others perform her dance, Kelley was disappointed when major creators and brands used it without giving her credit. She was reportedly in negotiations to license the dance to Roblox but said the platform used it without a signed agreement. Roblox’s legal team countered that they had reached an agreement to license the dance for $9,000 (£6,700) ahead of a Charli XCX-themed event. With millions of players on Roblox daily, the case has drawn attention to the rights of creators on online platforms.
